Three-way baby making is not new: genetic surrogacy existed in Biblical times and donor insemination was recorded in Britain over 200 years ago. However, the gift of gametes between women breaks all social conventions. This paper examines the phenomenon of gamete-donation questioning whether a ‘gift’ of such magnitude can ever be ‘free’ (as the Human Fertilisation & Embryology Authority advocates), or a ‘true’ gift (in Derridian terms). Exploration of this unprecedented ‘gift’ from a psychoanalytic approach is supplemented by an interdisciplinary (...) one, drawing on the gift literature in philosophy, anthropology, ethnography and socioeconomics, as well as neonatal research and reproductive medicine. Critics note the dearth of analyses that take seriously the psychological ramifications of contemporary treatments, protocols and expectations in reproductive medicine. Based on psychoanalytic therapy within a clinical practice devoted to reproductive issues, the author argues that institutionalised asexual reproduction alters unconscious conceptualisations of the act of procreation – converting the passionate intimacy of primal scene into a clinical coupling of gametes in a mechanised arena. The author argues that, too charged to contemplate, the gamete's transcendent quality and blurring of elementary personae/res distinctions leads protagonists, including professionals, to defensive commodification. Multiple emotional meanings are ascribed to gifted gametes by each in the triangle of donor, recipient and offspring, illustrated here with verbatim material. This article addresses some of the far-reaching socio-political consequences for class, race, age, gender and sexuality of asexual reproduction, related to selection procedures and uneven global and local distribution of fertility treatment and its cost in financial, physical, practical and emotional terms. Similarly, feminist unease over (patriarchal) reproductive control and gatekeeping policies are considered, as well as ethical concerns over genetic manipulation, pre-implantation screening, sex selection, selective foetocide and potential exploitation of transnational donors and surrogates. Despite the contemporary revival of interest in topical invention among rhetoricians and informal logicians, the ‘commonplaces’ (loci communes) of classical rhetoric have received little attention. When considered at all, they are typically dismissed as sterile or mechanistic substitutes for genuine argumentative invention. A fresh examination of the texts of Cicero and Quintilian, however, suggests that these authors believe that the commonplaces have an important heuristic function, and an effort to understand this function is a matter of interest to contemporary students (...) of argumentation. The language of entropy is examined for consistency with its mathematics and physics, and for its efficacy as a guide to what entropy means. Do common descriptors such as disorder, missing information, and multiplicity help or hinder understanding? Can the language of entropy be helpful in cases where entropy is not well defined? We argue in favor of the descriptor spreading, which entails space, time, and energy in a fundamental way. This includes spreading of energy spatially during processes and temporal (...) spreading over accessible microstates states in thermodynamic equilibrium. Various examples illustrate the value of the spreading metaphor. To provide further support for this metaphor’s utility, it is shown how a set of reasonable spreading properties can be used to derive the entropy function. A main conclusion is that it is appropriate to view entropy’s symbol S as shorthand for spreading. (shrink)

From the beginning of the environmental crisis, a constellation of ecosophies, theories, ideologies, discourses, and narratives have irrupted in the emergent complex ground of environmental philosophy and political ecology. In this non-unifyable field of forces, sociological analysis has been intended to sketch maps and derive typologies to order the different views and standpoints in science, ecological thinking, and environmental ethics so as to guide academic research or political action. From this will to set and settle differences in thought and strategy, (...) a diversity of environmentalisms has emerged; the lines are drawn from North to South, rich to poor, masculine to feminine, naturalism to culturalism. Environmentalisms differentiate their sources, attachments, and derivations from mother theories and their approaches from different disciplines. Thus, the prefix eco- or the adjective environmental are attached to traditional disciplines. Latin American environmental thinking draws its sources from critical philosophical thought; it differs from other systems of thought by a radical epistemological concept of environment; and it acquires its identity from the cultural heritage of its peoples and the ecological potentials of its territories. The paper presents a historical overview of some characteristic differences between rhetoric and dialectic in the pre-modern tradition. In the light of this historical analysis, some current approaches to dialectic are characterized, with special attention to Ralph Johnson's concept of dialectical tier.

Perelman’s view of the role of persons in argument is one of the most distinctive features of his break with Cartesian assumptions about reasoning. Whereas the rationalist paradigm sought to minimize or eliminate personal considerations by dismissing them as distracting and irrelevant, Perelman insists that argumentation inevitably does and ought to place stress on the specific persons engaged in an argument and that the relationship between speaker and what is spoken is always relevant and important. In taking this position, Perelman (...) implicitly revives the classical conception of proof by character (ethos or “ethotic” argument), but despite an extended discussion of act and person in argument, The New Rhetoric does not give much consideration to the classical concept and confuses differing approaches to it within the tradition. The result is that Perelman treats the role of the speaker in argument only by reference to abstract techniques and does not recognize the importance of examining particular cases in order to thicken understanding of how ethotic argument works in the complex, situated context of its actual use. Consequently, Perelman’s account of the role of persons in argument should be supplement by reference to case studies, and to that end, I consider ethotic argument in W.E.B. Du Bois’ famous essay “Of Mr. Booker T. Washington and Others”. (shrink)

Legal contracts and litigation documents common to the American legal system were encoded in the eXtensible Markup Language (XML). XML also represents rules about the contracts and litigation procedure. In addition to an expert system tool that allows one to make inferences with that engine, a Graphical User Interface (GUI) generates the XML representing the rules. A rulebase is developed by marking up examples of the XML to be interpreted and the XML to be generated, analogously to Query By Example. (...) This article provides a broader context of the synergy between XML and artificial intelligence by including discussions of: (1) the role of Artificial Intelligence in handling routine litigation; (2) how the use of XML enables legal expert systems to get their `input' without the user having to enter the same information again for the expert system;(3) the advantages of XML markup over other forms of markup for documents; (4) the relationship between XML and ontologies; (5) other projects using XML with rules or legal affairs. In contemporary American scholarship, interpretation of Aristotle'sRhetoric has become the locus of sustained and sharp controversy. Differing views of theRhetoric and its significance have become tokens in a more general dispute about what rhetoric is or ought to be. This essay examines three central issues that have emerged in this larger arena of controversy: the relationship between Aristotelian and Platonic conceptions of rhetoric, the relationships among rhetoric, ethics, and epistemology in Aristotle, and the placement of rhetoric within Aristotle's system of (...) arts and sciences. La racionalidad ambiental se forja en un reencuentro de lo real y lo simbólico, en la resignificación del mundo y la naturaleza, en un entramado de relaciones de otredad entre seres y un diálogo de saberes, donde se reconfigura el ser, se reconstituyen sus identidades, y se forjan nuevos actores sociales en una política de la diferencia guiada por un deseo de saber y de justicia, en la reapropiación social del mundo y de la naturaleza. The typical kind of color realism is reductive: the color properties are identified with properties specified in other terms (as ways of altering light, for instance). If no reductive analysis is available — if the colors are primitive sui generis properties — this is often taken to be a convincing argument for eliminativism. That is, realist primitivism is usually thought to be untenable. The realist preference for reductive theories of color over the last few decades is particularly striking in light (...) of the generally anti-reductionist mood of recent philosophy of mind. The parallels between the mind—body problem and the case of color are substantial enough that the difference in trajectory is surprising. While dualism and non-reductive physicalism are staples, realist primitivism is by and large a recent addition to the color literature. And it remains a minority position, although one that is perhaps gaining support. In this paper, we investigate whether it should be accepted, and conclude it should not be. (shrink)

Siguiendo a Nietzsche, el rechazo por el sentimiento y las pulsiones están en el centro de la mirada racional e instrumental respecto de la naturaleza. La (...) búsqueda incesante del conocimiento objetivo nos ha llevado a olvidar las viejas preguntas acerca de cómo habitar el mundo; las mismas que la ilustración desechó en nombre del conocimiento científico y la dominación del mundo material.
